Two accused of unemployment payment fraud

Two Kalispell men have been charged with felonies in Flathead District Court for allegedly taking unwarranted unemployment payments.

Willie Nelson Davis, 31 and Bryan Fey, 49, each face one felony count of felony theft, a common scheme.

Special Assistant Attorney General Joseph Nevin wrote in court documents that Davis accepted unemployment benefits from Montana from Oct. 8, 2013 until March 24, 2015.

He allegedly reported earning $16,114 during that time. Records from Plum Creek Northwest Plywood indicated that Davis allegedly actually made $63,075 during that period.

Nevin claims that Davis was overpaid unemployment benefits in the amount of $18,044. The state also wants the judge to assess a penalty and have Davis pay the state $27,066 for the alleged crime.

In a separate case, Nevin claims that between Feb. 19, 2011, and May 25, 2013, Fey allegedly reported earning $6,581, but Plum Creek Northwest Plywood records allegedly showed that he earned more than $13,000.

The state is also seeking a penalty in this case, bringing to $7,930 the amount Fey allegedly owes the state.

Arrest warrants for $5,000 were issued by Flathead District Court Judges Heidi Ulbricht and Robert Allison.
