Alleged criminal earns felony when officers approach him about misdemeanor crime

Brandon Shawn Alcayde earned himself a felony count of assault on a peace officer when a Ronan police officer attempted to detain him for alleged misdemeanor unlawful restraint this January, according to a Lake County Sheriff’s affidavit.

The officer deployed his taser after Alcayde refused to comply with the officer’s commands, records said.  

Alcayde’s trouble began earlier that day after a female victim told law enforcement she was being held against her will, the affidavit said.

When located by the officer, the unnamed victim was walking along-side of a road, records said.

A short time later, the officer found the victim’s car at Alcayde’s home.

“As the officer walked toward the door, a male outside began to yell at the officer telling him he had to leave,” the affidavit said. “At first the defendant was uncooperative and then became agitated again.”

But Alcayde sealed his own fate when he admitted to be driving the car in which the victim was unlawfully restrained, the affidavit said. 

That’s when Alcayde displayed his knowledge of the law, the records said.

“(Alcayde) claimed that he could not be arrested because the officer was on his property without permission,” the records said. “The defendant refused to comply with the officer’s orders to turn around and place his hands behind his back.”

Further, Alcayde began moving toward the police officer’s car, the records said.

“Fearing for his safety, the officer activated his taser and ordered (Alcayde) to the ground,” records said.

It took 30 seconds for Alcayde to comply, but he was eventually taken into custody, the records said. 

Alcayde, who was on the ground when cuffed, fought the officer when getting up as well as when placed against the back of the police vehicle, the records said. 

Alcayde was charged with felony assault on a peace officer, and misdemeanor unlawful restraint.

Now Alcayde’s case is working its way through the Lake County court system.
