A man is facing one felony and two misdemeanor charges after allegedly fleeing probation officers twice on May 5 and injuring an officer in the process.
Kyle Kenneth Smith, 25, was charged Wednesday in Flathead District Court with one count of felony assault on a peace officer, one count of misdemeanor escape and one count of misdemeanor criminal mischief.
According to court documents, Smith, who is on state probation, was stopped by two Probation and Parole officers in a business parking lot off U.S. 93 in Kalispell.
Smith allegedly began running after an officer tried to place him under arrest. One of the officers was able to catch and tackle Smith, but Smith got free and allegedly kicked the officer in the chest, injuring him.
Smith resumed running, but the injured officer was able to recapture Smith after he became stuck in a barbed-wire fence. Smith allegedly tried to punch the injured officer as he was taken into custody.
At the Flathead County Detention Center, he allegedly kicked open the door of the vehicle, slipped out of his handcuffs and ran away. The vehicle was damaged in the process. Smith was found a few hours later by law enforcement near Seventh Avenue West in Kalispell.
Smith will be arraigned on June 2 before Flathead District Judge Amy Eddy.
Smith will face a petition to revoke his suspended sentence on June 9 before Judge Eddy. He is currently on probation for two convictions: criminal possession of dangerous drugs in 2011 and issuing a bad check in 2013.
