On 4/20/16 Litehouse Cheese had two violations of Sandpoint's Municipal Sewer Ordinance for discharging waste water with Biological Oxygen Demand (BOD) and Fats, Oils and Grease (FOG) in excess of their permit limit. Per city code each violation requires a minimum $250 fine and recovery of any costs to the city. Litehouse Cheese has installed cages on their drains to catch any excess cheese from finding its way down the drain and is working with employees on training to prevent excess wastes from entering the city system. MINUTES FOR THE BONNER COUNTY BOARD OF COMMISSIONERS' MEETING May 3, 2016 PROSECUTOR - Approved the Thompson Reuter purchase order ID 769340 & 764461 and authorized the Chairman to sign. SHERIFF/PROSECUTOR - Commissioner Sudick made a motion to approve Ordinance No. 552 and the Ordinance "Summary" amending the Bonner County Revised Code, Title 3, Chapters 1 through 7, by expanding and consolidating the definitions section, by adding a new section for no wake zones for rivers, by clarifying restricted zones, by updating the penalties provisions and by adopting an infraction penalty schedule, providing for severability, and providing for and effective date. Commissioner Bailey seconded the motion. ROLL CALL VOTE: Commissioner Sudick: Yes, Commissioner Kelly: Yes, Commissioner Bailey: Yes. All in favor. The motion passed. CLERK - Approved the Amendment to the Tyler Software Contract for the purchase of the Project and Grant Accounting Module, and the elimination of the unneeded conversions as described in the supporting documents, and allowed the Chairman to sign the Amendment administratively. PUBLIC WORKS - Approved the Waiver of Solid Waste Fees for the City of Oldtown Clean-up Day schedule for May 14, 2016. Approved the request of Waiver for solid waste fees for the City of Sandpoint Clean-Up Day scheduled for June 6th, 2016 through June 10, 2016. AIRPORTS - Approved the agreement with JUB Engineers for the Design, Bidding, and Construction Phases of the Obstruction Removal project at Sandpoint for $18,240 and authorized the Chairman to sign the contract administratively. MISCELLANEOUS - Approved the Letter of Intent to the Animal Damage Control Board District #1/Wildlife Services outlining the Bonner County Commissioners intent to provide them with $4,000.00 during the state fiscal year 2017 (July 1, 2016- June 30, 2017). Approved the Legal Service Agreement with Doney Crowley, Attorneys at Law. This agreement authorizes legal services in connection with the filing of a motion to intervene as a party defendant in the 2016 Lawsuit between the Alliance for the Wild Rockies and the U.S. Fish and Wildlife Service. There was a brief discussion between the audience and the BOCC. Commissioner Sudick seconded the motion. All in favor. The motion passed. ORDINANCE NO. 552 SUMMARY Title 3, Public Waters, Amendment Bonner County Revised Code AN ORDINANCE OF BONNER COUNTY, IDAHO, SETTING FORTH ITS AUTHORITY; AMENDING TITLE 3, BONNER COUNTY REVISED CODE, BY AMENDING CHAPTERS 1 THROUGH 7, BY EXPANDING AND CONSOLIDATING THE DEFINITIONS SECTION TO INCLUDE DEFINITIONS FOR BRIDGE, COME BACK BAY, FACILITY, MOORING, MOORING BUOY, MOTORBOAT, NO WAKE, PADDLEBOARDING, PEND OREILLE RIVER, STANDUP PADDLEBOARDING, WATERSKIING, AND WATERWAYS, BY ADDING A NEW SECTION FOR NO WAKE ZONES FOR RIVERS, BY CLARIFYING RESTRICTED ZONES, BY UPDATING THE PENALTIES PROVISIONS AND ADOPTING INFRACTION PENALTY SCHEDULE A, PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE. SECTION I: Authority This Ordinance is adopted pursuant to the authority granted in Title 31 of the Idaho Code. SECTION II: Bonner County Revised Code, Title 3, Chapters 1 through 7, are amended as follows: A. 3-102: DEFINITIONS Amending to apply to all of Title 3 and to include definitions for: Bridge, Come Back Bay, Facility, Mooring, Mooring Buoy, Motorboat, No Wake, Paddle Boarding, Pend Oreille River, Stand-up Paddle Board, Water Skiing and Waterways. B. 3-103: BASIC RULE Amending to clearly designate a violation of this section as an infraction. C. 3-104: ADULT SUPERVISION AND AGE RESTRICTIONS Amending the title to include "and age restrictions and adding subsection "D" to clarify that a violation of this section is an infraction. D. 3-105: DISTANCES FOR NO WAKE ZONES ON LAKES AND THE PEND OREILLE RIVER Amending the title to include "on lakes and the Pend Oreille River." Amending subsection "A" to include bridge. Adding subsection "C" to clarify that a violation of this section is an infraction. E. 3-106: SPEED LIMITS ON SPECIFIED WATERS Amending the title to include "on specified waters." Adding that this section applies to Johnson Creek and Priest River from the mouth of the river upstream to the Outlet Bay. Deleting subsection "A" and relabeling the following subsections. Adding that this section now applies to speed limits on the Pend Oreille River. Adding subsection "F" to clarify that a violation of this section shall constitute an infraction. F. 3-107: SPEED LIMITS FOR RIVERS Adding that this section applies to Johnson Creek and Priest River. Adding that the speed limits on the Pend Oreille River are the same as on Pend Oreille Lake. Adding subsection "D" to clarify that a violation of this section shall constitute an infraction. G. 3-107A: NO WAKE DISTANCES FOR RIVERS Adding 3-107A as a new section. Adding specific no wake limits for the Clark Fork River, Priest River, Come Back Bay, and Johnson Creek. Adding an exception for watercraft being operated under emergency conditions. Adding that the no wake distances on the Pend Oreille River are the same as on Pend Oreille Lake. Adding that a violation of this section shall constitute an infraction. H. 3-108: NOISE Adding that a violation of this section shall constitute an infraction. I. 3-109: RESTRICTED ZONES Adding Albeni Falls Dam, Cabinet Gorge Dam and Pack River to the list of potential restricted zones. Adding a definition for nonmotorized vessel zone. Amending the definition of "No Swimming Zone". J. 3-110: RESTRICTED ZONES; VIOLATIONS Adding that a violation of the following restricted zones is a misdemeanor: Albeni Falls Dam, Cabinet Gorge Dam, and Pack River. Adding that a violation of all other zones constitutes an infraction. K. 3-111: PERSONAL WATERCRAFT SAFETY REGULATIONS Adding that a violation of this section constitutes an infraction. L. 3-112: WATERSKIING SAFETY REGULATIONS Adding that a violation of this section constitutes an infraction. M. 3-113: ELUDING A PEACE OFFICER; FAILURE TO YIELD Adding that eluding is a misdemeanor. Adding that failure to yield is an infraction. N. 3-114: USE OF COUNTY DOCKS AT FACILITIES WITH RAMPS WITH EXCEPTIONS Adding that a violation of this section shall constitute an infraction. O. 3-115: USE OF COUNTY DOCKS AT FACILITIES WITHOUT RAMPS Adding that a violation of this section shall constitute an infraction. P. 3-116: PARKING OF MOTOR VEHICLES AND TRAILERS Adding that a violation of this section shall constitute an infraction. Q. 3-117: BOAT SEWAGE DISPOSAL Adding that a violation of this section shall constitute an infraction. R. 3-118: DERELICT DOCKS AND FLOAT HOUSES Deleting subsection C and adding that a violation of this section shall constitute an infraction. S. 3-119: BOATER RIGHT OF WAY Adding that the Board of County Commissioners may adopt a Schedule B setting forth docks designated for public use. Adding that a violation of this section shall constitute an infraction. T. 3-122: PENALTIES Deleting subsections A and B. Adding that the Board of County Commissioners may adopt a Schedule A on a yearly basis setting forth infraction penalties, and adding that the schedule shall be posted at the Sheriff's Office, Courthouse and Commissioners Office. U. 3-123: MARINE EVENT PERMIT Adding that a violation of this section shall constitute an infraction. V. 3-124: HAZARDS TO NAVIGATION Adding that a violation of this section shall constitute an infraction. W. Chapter 2: PRIEST LAKE, UPPER PRIEST LAKE AND THE "THOROUGHFARE" Adding that a violation of 3-201 (Wakeless Speed in "Thoroughfare") and 3-203 (Water Skiing Prohibited in "Thoroughfare" and Upper Priest Lake) shall constitute an infraction. Adding that thoroughfare may also be designated as thorofare. X. Chapter 3: GAMLIN (GAMBLE) LAKE Deleting section 3-330 in its entirety. Y. Chapter 4: SHEPHERDS LAKE Deleting section 3-430 in its entirety. Z. Chapter 5: KELSO LAKE Deleting section 3-503 in its entirety. AA.
