Charge to elevate in road rage incident

SANDPOINT — A criminal charge is elevating against an Oldtown man accused using his pickup truck to ram an all-terrain vehicle that was being ridden by a 12-year-old boy.

Steven Michael Moore is charged with felony assault, although the state advised the court on Wednesday that it would be upgrading the charge to felony battery, a more serious offense.

Deputy Public Defender Susie Jensen objected to continuing with preliminary hearing proceedings on Wednesday because it would prejudice her client. Jensen argued that the amended complaint would add a new element to a more serious charge, court records show.

Bonner County Deputy Prosecutor Roger Hanlon argued that factual information in the case was essentially unchanged.

Judge Justin Julian ultimately ordered the hearing to be reset for June 8 so the state could file an amended complaint and the defense could prepare to defend against the new charge, court records indicate.

The alleged victim told sheriff’s deputies Moore followed him to his home on May 6 and threatened to kill him if he continued to speed through the neighborhood on the ATV. Moore, 60, allegedly used his truck to bump into the ATV the boy was sitting on, causing the vehicle to lurch several feet forward, according to a probable cause affidavit. The boy was not injured but feared violence was imminent.
