Kalispell man wanted on child rape charge

A $100,000 arrest warrant has been issued for a Kalispell man accused of raping a 9-year-old girl.

Flathead District Judge Robert Allison issued the arrest warrant for Justin Charles Hernandez, 31, on Tuesday.

Hernandez has been charged with felony sexual intercourse without consent in Flathead District Court.

According to court documents the alleged victim’s mother reported to police Aug. 16 that the girl had been sexually assaulted.

The child was interviewed the next day and described multiple instances in which Hernandez allegedly touched her inappropriately and raped her in the basement of a Kalispell home. The child’s mother allegedly received apologetic text messages from Hernandez after the child was interviewed by police.

If convicted, Hernandez faces a minimum of 25 years in prison without chance for parole. The maximum possible penalty for sexual intercourse without consent is 100 years in prison and a $50,000 fine.

An arraignment date has not yet been set.
