Authorities try to revoke rapist's release

Authorities have arrested a man for probation violations after he was released from prison last year.

Anthony Lee Evans, 31, of Bozeman had served 16 years for holding a girl at gunpoint, tying her to a tree and raping her behind the Martin City Fire Hall in June 1998.

Evans was arrested Wednesday on a $50,000 warrant. According to court documents, in July Evans was found in possession of alcohol, a tactical-style knife with a thumb-assist opening device, and pornographic content on his cellphone.

None of those are allowed as a part of his probationary sentence.

Evans also allegedly has not paid $1,400 for sex-offender treatment and is considered to be out of compliance by his sex-offender treatment provider. He also has not followed through with required mental health counseling.

Evans’ probation officer has recommended that Evans be returned to prison. He originally was sentenced to 40 years in Montana State Prison with 24 years suspended.

“It is this officer’s opinion that the defendant continues to believe he is the victim in his crime, he refuses to abide by his conditions, refuses to pay for his treatment, and therefore continued community placement is far too great of risk,” the probation officer wrote.

Evans was sentenced for the rape when he was 16 years old. At the time, he had already served time in the Pine Hill Correctional facility for stealing $1,000 from a woman’s purse and threatening a school bus driver with a gun.

Evans also had faced murder charges after he confessed to killing a 6-year-old girl.

The murder charge, however, was dropped in 2000 after the Montana Supreme Court unanimously threw out the confession he gave about drowning his neighbor, Megan Lamanna of Hungry Horse.

The high court found that Evans’ confession was not given voluntarily because during the 2 1/2 hour interview, he was not read his Miranda rights in the presence of a parent. Evans was 14 at the time of Lamanna’s death.

A hearing date for Evans’ probation revocation has not yet been set.
