Eureka man pleads not guilty to felony charge

A Eureka man, David Leon Ibach, pleaded not guilty Monday, April 17, 2017 to the offense of assault with a weapon, a felony or in the alternative, criminal endangerment, a felony.
Ibach was arrested on March 29, 2017 after Samantha Arbgast contacted Eureka Dispatch to report that David Ibach had allegedly shot a window out of their vehicle and then fired another round towards their trailer house.
According to the affidavit of probable cause, Arbgast and Douglas Hume had been driving their truck to the green boxes to dispose of garbage when they slowed to let Ibach pass them. Ibach allegedly pulled up to Hume’s vehicle and stopped at the driver’s window. Hume said that Ibach reached into the vehicle to grab him and he drove off. Ibach allegedly fired a round from his gun through Hume’s truck breaking the back window.
Hume claimed that the issues with Ibach had started March 26, 2017, when a friend of Hume’s, Jared Gibbs, allegedly shot Ibach’s dog for chasing deer.
If convicted of assault with a weapon, Ibach could face a punishment of imprisonment in the state prison for a term not less than 20 years or a fine in an amount not to exceed $50,000, or both, or in the alternative charge of criminal endangerment which is punishable by imprisonment in the state prison for a term not to exceed 10 years or a fine in an amount not to exceed $50,000, or both.
