LEGAL NOTICE Pursuant to 42 CFR 440.386, and in compliance with the provisions of section 5006(e) of the ARRA of 2009, the Department of Health and Welfare is giving public notice of an impending change in the Idaho Medicaid State Plan. Idaho Medicaid intends to submit a State Plan Amendment in order to comply with the provisions of Section 56-254, Idaho Code, as amended. This law directs the Department of Health and Welfare to provide coverage for children under age 18 with serious emotional disturbance (SED) with family incomes up to 300% of the federal poverty level. This legislation allows the Department to comply with the Jeff D. settlement agreement (U.S. District Court Case No. 4:80-CV-04091-BLW) in a manner that most efficiently leverages state general funds. This new Medicaid program is known as Youth Empowerment Services (YES). The effective date of these changes is January 1, 2018. This legislation has a net zero impact to the General Fund and a federal fund spending authority impact of $2,968,400 in the Division of Medicaid. Currently, the Division of Behavioral Health's Children's Mental Health program is appropriated $1,181,600 General Fund for services that do not draw a federal match. This General Fund appropriation will be transferred to the Division of Medicaid to leverage matching federal funds through Federal Medical Assistance Percentage (FMAP) funding. In future years, there is an anticipated annual ongoing cost of $8,300,000 ($2,363,200 General Fund/$5,936,800 federal funds), which will be similarly offset for a continued net zero General Fund impact.
