Hutto's roommate likely to face charges

COEUR d'ALENE — A second suspect will likely be charged in connection with the crimes committed by David Hutto.

Kootenai County Prosecutor Barry McHugh told The Press he anticipates the state will bring charges against Justin Roy Booth in relation to Hutto’s case.

Hutto pleaded guilty last week to kidnapping, robbing and murdering Bo Kirk last October. A fourth charge of arson was dropped as part of a plea agreement.

McHugh said he can’t discuss the specific charges being considered for Booth or discuss a timeline for an arrest.

Kirk, the father of three, went missing Oct. 22 after leaving his job as an X-ray technician at Northwest Specialty Hospital in Post Falls.

Later that night, surveillance cameras captured two people in what police investigators said they believed was Kirk’s truck at a bank drive-through in Dalton Gardens and another in Hayden. The driver used Kirk’s debit card to withdraw an undisclosed amount of cash in three separate transactions.

Later still that evening, Kirk’s 2015 GMC truck was found engulfed in flames in a northern section of the county.

Hutto was arrested Oct. 27 at the Coeur d’Alene Burger King. The same day, Booth, Hutto’s former roommate and business partner, was arrested and taken into custody for being in possession of a firearm, a federal crime for a felon. The gun was found when authorities searched Booth and Hutto's Hayden home on Oct. 27.

Booth has been in federal custody and housed in the Bonner County Detention Center since October, but no charges have been filed against him yet in connection with Kirk, although he was questioned by police.

When Hutto appeared in court in November, Kootenai County Sheriff’s Sgt. Ken Lallatin said Booth provided information about his and Hutto’s involvement in Kirk’s death in the testimony,

Investigators said Hutto followed Kirk to his home after a road-rage incident on Oct. 22 before kidnapping him, robbing him, shooting him and burning his vehicle.

It remains unclear what Booth’s specific involvement was in the crimes because the interview transcripts are not being made public yet since Booth has not yet been charged.
