Woman arrested in Libby for drug charges

A Billings woman was arrested in Lincoln County Sunday and charged with driving with a suspended license and possessing a marijuana pipe.

Josefine May Smiley, 27, is being held on a $2,500 bail for criminal possession of drug paraphernalia, driving a motor vehicle with a suspended or revoked license, and not having liability insurance.

The charges carry a maximum penalty of a $500 fine and up to six months in jail. For driving a vehicle while suspended or revoked, the penalty includes a minimum of two days of custody and up to 40 hours of community service.

Officer Anthony Jenson arrested Smiley Feb. 19 when he responded to a crash on U.S. Highway 2 at 3:37 a.m.

According to court documents, Smiley was sitting in a white Buick Century that was stuck in the snow on the westbound side of the highway. The vehicle had struck a deer at mile marker 69.

Smiley reportedly told Jenson that she didn’t have insurance and had a suspended license. Montana Highway Patrol confirmed her license was suspended in Montana as well as Washington. Smiley also had a warrant from Gallatin County Justice Court.

Smiley reportedly told Jenson that she had a glass pipe in her purse to smoke marijuana. Jenson reportedly found a small glass pipe that smelled of burned marijuana in the purse.

Smiley is set to appear before Judge Jay Sheffield at the Lincoln County Justice Court for an omnibus hearing April 13 at 1:30 p.m. Jury Trial is set for June 14 at 9 a.m.
