Former GCSO reserve candidate sentenced for molestation

MOSES LAKE — A former Grant County reserve deputy candidate was sentenced for molesting a 12-year-old girl in Moses Lake.
Kevin McMains, 24, of Moses Lake, was convicted of second-degree child molestation following a jury trial. The charge carried with it a standard sentencing range of 15-20 months. Grant County Superior Court Judge John Knodell sentenced McMains to 15 months of confinement, with 36 months of community custody.
On Dec. 8, 2015, the Moses Lake Police Department received a call from Child Protective Services (CPS) about the potential rape of a child and molestation, which was reported to an online teacher by the 12-year-old victim. The victim told investigators she had been raped and identified the suspect as McMains, who was then enrolled at the Grant County Sheriff’s Office’s reserve academy, according to court documents.
The victim’s family expressed concern about McMains living a couple of doors down from their home. They advised McMains, “always had access to come and go from their residence at will.” The victim’s father detailed two incidents in which McMains had molested his daughter. He said the first incident occurred on a couch after his daughter fell asleep and the second occurred when McMains climbed under a blanket with the girl and molested her.
The victim told police she came home after a large Thanksgiving family gathering at a friend's house and started playing video games. She said she fell asleep on a couch and woke up about 2 a.m. as McMains was touching her. She also claimed that McMains performed a sex act on her.
"She (the victim) believed if McMains would rape a 12-year-old why wouldn't he shoot one when he got caught," wrote an investigator. "Therefore, she lay there the rest of the night while it was happening, pretending to be asleep until it stopped.”
McMains admitted to being on the couch with the victim and claimed he rolls around a lot in his sleep and “maybe touched her that way.” He denied ever attempting to inappropriately touch or kiss the victim, according to court documents.
