Man charged with rape, sexual abuse

SANDPOINT — A Sagle man was arrested Thursday on charges of rape and sexual abuse of a child under the age of 16.
Caleb Daniel Barber made an initial appearance in Bonner County Magistrate Court via video feed from the jail. Judge Tera Harden sustained Barber’s $30,000 bail and appointed a public defender to represent him, court records indicate.
Barber, 19, is accused of attempting to solicit a 15-year-old girl into having a sexual encounter on April 15. He allegedly drove the teen to a secluded location and made sexual advances, which were rebuffed. However, Barber is accused of kissing and groping the teen during the incident.
On April 16, a criminal complaint alleges, Barber had sex with a different 15-year-old. The sexual contact was consensual, although it amounted to statutory rape due to their respective ages, according to court documents.
Barber attended a party in Oldtown with the second teen on April 22, but the gathering was busted by law enforcement. They returned to Barber’s residence in Sandpoint and the girl fell asleep on Barber’s bed.
The teen said Barber woke the next morning and told her to take a shower, a probable cause affidavit said. When she inquired why that was necessary, Barber allegedly reminded the teen that they had sex during the night.
The teen told police that she did not agree to have sex with Barber on April 22 and was incapable of giving consent due to her level of intoxication, court records indicate. The charge stemming from that incident alternatively alleges that Barber engaged in statutory rape or the teen was incapable of resisting due to intoxication.
A preliminary hearing in the case is set for Wednesday.
