Couple seeks damages for destroyed home

SAGLE — A Washington state couple is seeking damages against Bonner County after their home was knocked off its foundation and turned on its side during a landslide near Lake Pend Oreille’s Talache Landing on March 18.
Lee and Myloa Stewart of Spokane Valley are seeking $367,265 in damages, a sum which reflects the Talache Beach Road home’s assessed valuation by the Bonner County Assessor’s Office. The couple said there was no estimate yet on the cost of the home’s removal and replacement.
The modest home was upended when a portion of Talache Beach Road failed above the home amid soaking rains. The summer residence was not occupied when the road above it gave way.
The tort claim, which serves as a notice of intent to sue unless damages are awarded, was filed in 1st District Court on Monday.
If the claim is rejected, the Stewarts would be permitted to recover damages through a civil action in 1st District Court.
Bonner County officials, by policy, do not comment on pending tort claims.
It was not immediately clear on Thursday if Talache Beach Road is a privately maintained public roadway or a public route that maintained by the county.
