Plea deal sidesteps trial in rape case

SANDPOINT — A Priest River teen charged as an adult for allegedly raping another teen is entering into a pretrial settlement agreement to resolve his case, 1st District Court records show.

Ryan Nathanial Greene pleaded guilty to an amended charge of lewd and lascivious conduct with a minor on Tuesday, the day his three-day jury trial was slated to get underway.

The penalties for rape and lewd conduct are substantially similar. Rape has a mandatory minimum of a year in prison, while lewd conduct does not. Both charges, however, carry the prospect of lifelong imprisonment and required registration as a sexual offender.

Bonner County Deputy Prosecutor Nick Lepire advised the court on Monday that he will recommended a 10-year prison term and a $5,000 civil penalty, court records indicate. The pretrial settlement agreement is not binding upon the court, which leaves the sentence to its discretion.

Greene, who was 17 at the time of the alleged offense, was charged with kidnapping and forcible rape after an alleged attack on a 14-year-old Priest River girl in June 2015. The charges didn’t materialize until last fall, after the alleged victim voluntarily admitted herself into Kootenai Behavioral Health Center in Coeur d’Alene because of suicidal thoughts.

Greene initially denied having sex with the teen, but later admitted having consensual intercourse with her, a Priest River Police officer testified.

The alleged victim testified at a preliminary hearing that Greene wanted to have sex with her, but she refused. Greene got on top of her, removed her clothes and held her down as he raped her, the teen told the court.

The teen further testified that she tried to push Greene off of her and told Greene “no” at least 10 times during the alleged assault.

Judge Debra Heise ruled following the hearing that there was insufficient evidence to sustain the kidnapping charge, but found there was sufficient evidence to justify trying Greene on the rape charge.

The kidnapping charge was ultimately dismissed by the state after the preliminary hearing.

Greene, now 18, is free on $20,000 bond while his case is pending. A sentencing hearing is set for July 10.
