Hearings reset in felony battery cases

SANDPOINT — Preliminary hearings have been reset for a Sandpoint attorney and his son, who are facing felony battery charges in connection with fight outside a bar last spring.
The preliminary hearings in the cases against Rex Adam Moyle Finney and Adam Oliver Finney are now set for Jan. 18, 2018. The hearings will determine if there’s sufficient evidence to justify trying the duo in 1st District Court.
Rex Finney, 43, is charged with two counts of aggravated battery causing great bodily harm. Adam Finney, 21, faces one count of aggravated battery causing great bodily harm.
The Finneys are accused of breaking a man’s collarbone or aiding or abetting one another in the commission of the crime. The elder Finney is further accused of kicking another man in the head.
The charges stemmed from a clash outside the Cabinet Mountain Bar & Grill in Clark Fork on April 22.
Witnesses told Bonner County sheriff’s investigators said they were attacked after one of them exchanged words with Rex Finney earlier in the evening, according to police reports. The Finneys emerged as suspects through witness interviews, photo lineups and video footage captured by the bar’s surveillance system.
Witnesses said the clash was more of an orchestrated attack than a garden variety bar brawl, according to court documents.
Criminal charges against the Finneys surfaced in October. They are each free on $5,000 bonds while their cases are pending.
The Kootenai County Prosecutor’s Office has been appointed to handle the case to avoid any appearance of a conflict of interest or improper use of discretion by the Bonner County Prosecutor’s Office, court records show.
Rex Finney has declined to comment on the matter.
