A Kalispell man has pleaded not guilty after being accused of strangling someone.

Joseph Isiah Kubai, 25, entered the plea in Flathead District Court on Aug. 16. He is charged with felony partner or family member assault — strangulation.

Flathead County Sheriff’s Office responded to a report of a physical disturbance between family members on Aug. 15. According to court documents a deputy arrived to find Kubai standing in the basement out of breath. Kubai allegedly admitted to confronting a family member, but denied he did anything more than sit on the victim and hold him down.

The victim told the deputy that Kubai had allegedly pushed him up against a wall, placing his hands around his throat. The victim reportedly almost passed out when Kubai allegedly cut off his breathing for a span of five to 10 seconds. Kubai threatened the victim by stating he would “gladly kill” the victim and “go to prison for it,” court documents state. The victim said he was very fearful of Kubai, who reportedly weighed more and was “well-versed” in martial arts. The deputy allegedly observed red markings around the victim’s neck, and the victim was later treated by medical personnel.

A jury trial has been set for January 2018. If convicted, Kubai may face up to five years in prison and a maximum $50,000 fine.
