Hearing pending in Thama rape case

SANDPOINT — A preliminary hearing is pending for a California teen accused of raping and intoxicated 15-year-old.

Alfredo Guerrero-Jimenez is charged with rape, sexual penetration with a foreign object and lewd and lascivious conduct. He is free on a $10,000 bond while the case is pending, court records show.

Guerrero-Jimenez, 17, allegedly raped the teen at residence in Thama on June 10. The teen’s mother told Bonner County sheriff’s officials that her daughter sneaked out of their home the night before to drink around a campfire in Pend Oreille County, Wash. The small group of revelers returned to Bonner County, with some retiring to a television room in the home.

The teen said she awoke the next morning to find her hand on Guerrero-Jimenez’s genitalia and his hand on hers, a probable cause affidavit said. While subsequently showering at her home, the teen discovered ejaculate.

Charging documents allege that the teen was unable to resist Guerrero-Jimenez’s misconduct due to intoxication. Witnesses said the teen had vomited several times while at the campfire, which caused the group to return to Bonner County, the probable cause affidavit said.

A disposable chemical application for seminal fluid on the teen’s undergarment showed a presumptive positive, according to court documents.

Guerrero-Jimenez was arrested by U.S. Customs & Border Protection officials last month in California. Guerrero-Jimenez listed a home address in Mira Loma, Calif.

A preliminary hearing in the case is set for Nov. 1 in Bonner County Magistrate Court.
