Sentencing is reset in Foster case

SANDPOINT — A sentencing hearing has been reset for a Blanchard man who pleaded guilty to wounding two Bonner County sheriff’s deputies in a shootout last year.
It’s the second continuance in Adam Deacon Foster’s sentencing hearing. A March hearing was called off so Foster could undergo a mental health evaluation.
The proceeding was rescheduled for next month, but is being pushed back because of scheduling conflict involving a defense witness who was set to testify on Foster’s behalf, court records indicate.
Foster’s sentencing is reset for June 5. He remains held at the Bonner County Jail in lieu of $2 million bond.
Foster, 32, is accused of shooting deputies Justin Penn and Michael Gagnon when they attempted to arrest him outside his Mountain View Road home on Jan. 16, 2017. Foster allegedly bolted from the deputies, took up a concealed position and opened fire with a .357 revolver when the deputies pursued him, according to court documents.
Despite being shot, Penn and Gagnon returned fire and wounded Foster, which brought an end to the gunbattle.
Penn, Gagnon and Deputy William Craffey resolved to arrest Foster on a warrant after he allegedly made threats of engaging in homicidal violence and vowed to kill law enforcement if they interfered with his plans, court documents indicate.
Foster was charged with two counts of attempted first-degree murder and two sentencing enhancements for inflicting great bodily harm on the deputies. Foster entered into civil mediation, which produced a resolution in the criminal case.
The charges against Foster remained intact, although the two sentencing enhancements were rolled into a single enhancement which accounts for both officers, court records indicate.
Foster faces up to 15 years in prison on each count, plus the 20-year sentencing enhancement, according to Idaho Code. Bonner County Prosecutor Louis Marshall has agreed to limit the state’s sentencing recommendation to 50 years, court records indicate.
