Assault suspect is sentenced

SANDPOINT — A former Oldtown man accused of threating one child and injuring another was given a suspended prison term on Monday, court records show.
David Fernandez Jr. was originally charged with aggravated assault for allegedly threatening a 4-year-old girl with a knife in November of last year. He was also charged with two counts of misdemeanor injury to a child for allegedly elbowing a 2-year-old in the abdomen, hitting the child in the face and roughly flinging the boy onto a couch with a wooden divider, which the boy hit his head on.
Fernandez, 23, entered into a pretrial settlement which saw the felony assault charge amended to a charge of attempted aggravated assault with a pair of scissors rather than a knife, court records show. In exchange for a plea to the felony, the two misdemeanor counts were dismissed.
Fernandez, now a resident of Globe, Ariz., had no remarks for the court before Judge Barbara Buchanan imposed the sentence, court records show. Buchanan imposed a one- to two-year prison term, which was suspended. Fernandez, who was given credit for 34 days of pretrial incarceration, was placed on probation for two years and ordered to pay more than $900 in fines and costs.
