Ponderay resident is accused of rape

SANDPOINT — A preliminary hearing is pending for a Ponderay man accused of forcible rape.

The felony charge against Wyatt Nathan Thurman emerged earlier this month following a Ponderay Police investigation.

Thurman, 19, is accused of raping a 16-year-old Coeur d’Alene girl at his apartment on April 1. A criminal complaint alleges that the teen resisted Thurman, but her resistance was overcome by force.

The teen told police that she accompanied Thurman to his place, where he removed most of his clothes and began kissing her, a probable cause affidavit alleges. He allegedly pushed her back onto a bed, straddled her waist and pinned her wrists above her head. The teen allegedly told Thurman she did not want to have sex and his advances relented, the affidavit said. However, he later resumed his advances, disrobed her and had sex with her when she was unable to squirm away from him.

The teen later took a bat to Thurman’s car over allegedly disregarding her lack of consent, court documents indicate.

Thurman told police the sex was consensual, although he later acknowledged that it was possible that she did not want to have sex and that his hormones had gotten the better of him during the encounter, according to the affidavit.

Thurman has no prior criminal record in the state of Idaho, according to the Idaho Supreme Court Data Repository. Thurman is free on $25,000 bond while the case is pending.
