P&Z revisiting code change proposal

SAGLE — The Bonner County Planning & Zoning Commission is revisiting proposed changes to the county’s land use code on Wednesday, May 9.

The public hearing begins at 6 p.m. at the county’s EMS/Multi Use facility at 465838 U.S. Highway 95, just north of Dufort Road.

The county is proposing to increase an existing administrative exception from 1 foot to 10 percent on setbacks and from 2-5 percent on lot size and subdivision design. The code amendments would also create an administrative variance of up to 30 percent with a public hearing option. Variances greater than 30 percent would be subject to the standard variance process.

A third proposed code change involves conditional certificates of compliance. It would move the date for which a parcel may legally exist to the adoption date of last major land use code rewrite (Nov. 18, 2008).

The planning commission remanded those changes for further review following an April 10 public hearing in which the proposed changes were lauded and opposed. Some also argued that the changes, which are part of an ongoing effort to ease the regulatory burden on landowners, were unnecessary.

The planning commission agreed to remand the items for additional review, but stipulated that it would issue recommendations to the board of county commissioners no later than May 10.
