Prison ordered in threat case

SANDPOINT — A Bonner County man is being ordered to serve up to a year in prison for allegedly threatening two people with a pistol during a confrontation south of Oldtown last year.
First District Judge Barbara Buchanan imposed a one- to three-year prison term in Brandon Scott Cramer’s case, but retained jurisdiction over the defendant, court records show. After serving up to a year in prison, Cramer can be considered for release onto probation.
Cramer, 33 , was charged with two counts of aggravated assault, but the case was dismissed without prejudice after Cramer’s friends and family provided an alibi for him during the October 2017 confrontation on Dry Creek Road. However, the charges were reinstated and Cramer’s alibi witnesses were charged with perjury.
Cramer ultimately entered an Alford plea to one count of felony assault. Under the terms of the plea, Cramer admitted no wrongdoing but agreed he could be convicted of the offense if the case went before a jury.
Cramer was sentenced on July 16. Jurisdiction was retained over Cramer, which is also known as a rider. After serving up to a year in prison, Cramer can be considered for release onto probation. However, if things go poorly during his prison stint, he could be ordered to serve the underlying sentence. Under the terms of the plea agreement, the second felony assault count was dropped, as was a sentencing enhancement for using a firearm during the commission of a crime, court records show.
Two people who perjured testimony — WendyJo Cramer and Steven Craig Walkup — entered into plea agreements and received 10-day jail sentence. A third — Megan Marie Albertson — was convicted by a jury of perjury earlier this month and awaits sentencing in 1st District Court.
