Plea deal reached in sex abuse case

SANDPOINT — A case against a Post Falls man accused of sexually exploiting a vulnerable woman in Bonner County is expected to be dismissed after agreeing to plead guilty to identical charges in Kootenai County.
Both cases against Rex Daniel Clark involve the same 38-year-old victim, who is developmentally disabled and has the capabilities of seven-year-old child, according to court documents. Clark’s wife was the woman’s caregiver.
Clark, 56, had sexual contact with the woman at a Kelso Lake cabin in 2017, charging documents in Bonner County allege. He’s further accused of having sexual contact with the woman in Kootenai County in 2017.
Clark entered into a pretrial settlement agreement earlier this month in Kootenai County, court records show. The charge against Clark could be reduced to simple abuse of vulnerable adult if a full-disclosure polygraph examination yields no additional victims and a psychosexual evaluation determines Clark’s risk of re-offending is average or below average.
A sentencing hearing in the Kootenai County case is pending. Clark’s defense counsel, Coeur d’Alene attorney Sean Patrick Walsh, advised Judge Barbara Buchanan during a pretrial hearing on Friday that the Bonner County case is expected to be dismissed upon resolution of the Kootenai County case, records show.
Sexual abuse of a vulnerable adult is a felony punishable by up to 15 years in prison, according to Idaho Code. Abuse of a vulnerable adult, also a felony, is punishable by up to 10 years in prison.
The allegations surfaced last June, when the alleged victim advised Clark’s wife that he was cheating on her.
The alleged victim underwent a forensic evaluation in Coeur d’Alene, where she disclosed that Clark had sexual contact with her on a number of occasions over a two- to three-year period, court documents indicate.
Clark initially denied inappropriate conduct with the woman, but later admitted that he had touched her genitals and breasts, in addition to having her perform oral sex, an affidavit in the Bonner County case said.
Clark insisted the sexual conduct was consensual, although the woman was unable to give consent because she met the statutory requirements of being a vulnerable adult, court records show.
