MINUTES FOR THE BONNER COUNTY BOARD OF COMMISSIONERS' MEETING October 16, 2018 SOLID WASTE Approved Resolution #18 -123 Solid Waste Budget revision and authorize the Clerk to open the budget and increase line item 023-7350 in the amount of $427,419.00 from the unanticipated revenues. EMS Approved and sign the commercial lease agreement for 521 N. Third Ave. Sandpoint, ID 83864. A one year lease agreement between Third Ave, LLC and Bonner County at a rate of $5,925.13 per month for the building in which Bonner County EMS currently resides. Approved the medical director consent and dispatch agreement for all the fire protection districts who wish to be considered collaborative agencies with Bonner County during the fiscal year of 2019. PROSECUTOR Tabled the Prosecutor's Item until the contract can be reviewed. At 9:22 a.m. the meeting was recessed. At 9:33 a.m. the meeting was reconvened. EXECUTIVE SESSION At 9:33 a.m. Commissioner Connolly moved to enter into Executive Session under Idaho Code § 74-206 (1) (A) Hiring with Cindy Binkerd. Commissioner McDonald seconded the motion. Roll Call Vote: Commissioner McDonald - Aye, Commissioner Bailey - Aye, Commissioner Connolly - Aye. The motion passed. Commissioner Bailey reconvened the meeting at 9:40 a.m. Instructions on how to proceed have been given to the Human Resources Department. EXECUTIVE SESSION At 9:40 a.m. Commissioner McDonald moved to enter into Executive Session under Idaho Code §74-206 (1) (B) Personnel with Cindy Binkerd. Commissioner Connolly seconded the motion. Roll Call Vote: Commissioner McDonald - Aye, Commissioner Bailey - Aye and Commissioner Connolly - Aye. Commissioner Bailey reconvened the meeting at 10:16 a.m. Instructions on how to proceed have been given to the Human Resources Department. Commissioner Bailey stepped down from the chair and seconded the motion. Commissioner McDonald has recused himself due to being part of an active campaign. Roll Call Vote: Commissioner Bailey - Aye and Commissioner Connolly - Aye. The motion passed. Commissioner Bailey reconvened the meeting at 10:30 a.m. Commissioner Connolly made a motion to waive the prohibition contained in the Bonner County Road Standards Manual (BCRSM) against the posting of political signs in the County Right-of-Way through the November 2018 general election, with the exception of any threats to life or property. Commissioner Bailey stepped down from the chair and seconded the motion. All in favor. The motion passed. Commissioner McDonald recused himself, Commissioner Bailey - Aye, Commissioner Connolly - Aye. Unanimous. The motion passed. Commissioner Bailey reconvened the meeting at 10:40 a.m. Commissioner Connolly made a motion to engage Simmons Hanly Conroy LLC as counsel in relation to claims against opioid manufacturers and opioid distributors. This retention is necessary. Commissioner Bailey stepped down from the chair and seconded the motion. All in favor. The motion passed.There being no further business to come before the meeting, at 10:42 a.m. Chairman Bailey adjourned the meeting. On Tuesday, October 9, 2018, a Planning Update was held pursuant to Idaho Code §74-204(2). On Wednesday, October 10, 2018 a Planning Hearing was held pursuant to Idaho Code §74-204(2). Commissioner McDonald made a motion to approve, this project FILE AM 164-18 a comprehensive plan map change from Neighborhood Commercial to Rural Residential, finding that it is in accord with the general and specific objectives of the Bonner County Comprehensive Plan and Bonner County Revised Code as enumerated in the following conclusions of law, and based upon the evidence submitted up to the time the Staff Report was prepared and testimony received at this hearing. I further move to adopt the following findings of fact and conclusions of law as written (or as amended). This action does not result in a taking of private property. Commissioner McDonald made a motion to approve this project FILE ZC367-18 to change the zoning designation for the subject property from Suburban to R-5 with 5 acre minimums, finding that it is in accord with the general and specific objectives of the Bonner County Comprehensive Plan and Bonner County Revised Code as enumerated in the following conclusions of law, and based upon the evidence submitted up to the time the Staff Report was prepared and testimony received at this hearing. Commissioner McDonald made a motion to approve an Ordinance of Bonner County, Idaho, the number to be assigned, citing its authority, and providing for the amendment of the Official Zoning Map of Bonner County by the reclassification of lands generally located in Section 22, Township 56 North, Range 5 West Boise Meridian from Suburban to R-5, and providing for an effective date. I further move to authorize the Chair to sign the official supplementary zoning map upon publication of the ordinance. Commissioner Bailey stepped down from the chair and seconded the motion.
