Hearing reset in felony battery case

SANDPOINT — A preliminary hearing was postponed Thursday for a Sandpoint attorney and his son, both of whom are implicated in a felony battery case.
The state and defense in Rex Adam Moyle Finney and Adam Oliver Finney’s cases jointly agreed to put off Thursday’s hearing and reschedule it for a date that is more convenient for court and counsel, court records indicate. The hearing, in which a judge determines if there’s sufficient evidence to warrant a trial, was reset for Feb. 22.
Rex Finney, 43, is charged with two counts of aggravated battery resulting in great bodily harm. Adam Finney, 21, is charged with one count of aggravated battery causing great bodily harm. The pair is accused of breaking a man’s collarbone or aiding and abetting one another in perpetrating the crime. Rex Finney is further accused of kicking another man in the head.
The charges arose from a confrontation inside and outside the Cabinet Mountain Bar & Grill in Clark Fork in April 2017. The alleged victims said words were exchanged with Rex Finney earlier in the evening, according to Bonner County sheriff’s deputy reports.
The Finneys left the bar, but later returned in what the alleged victims characterized as an orchestrated attack as opposed to a spontaneous bar scuffle, court records indicate.
The Finneys secured their pretrial liberty through a pair of $5,000 bonds. Rex Finney has declined to comment on the matter.
The Kootenai County Prosecutor’s Office is handling the case against the Finney to avoid any appearance of a conflict of interest or improper use of discretion by the Bonner County Prosecutor’s Office.
The cases against both defendants are being consolidated for the purposes of the preliminary hearing, court records show.
