Teen charged as adult in case

SANDPOINT — A Bonner County teen is being prosecuted as an adult on rape and felony assault charges, according to court documents.
A preliminary hearing in the case against Payton J. Cox is set for June 30 in Bonner County Magistrate Court.
He is free on his own recognizance while the case is pending, court records show.
Cox, 17, is charged with one count of rape and two counts of aggravated assault. The charges date back to early February, when Cox and other teens attended a Super Bowl party at a Oden-area home, according to a probable cause affidavit.
Cox allegedly pointed a loaded shotgun at a 14-year-old girl and another party attendee during a verbal disagreement, the affidavit said.
Alcohol was consumed was consumed during the party and the 14-year-old fell asleep on a couch. She awoke to Cox putting his hands in her pants and asking for sex, the affidavit said.
The 14-year-old told investigators that she repeatedly informed Cox she did not want to have sex. Cox, however, ignored her protests, according to court documents. A criminal complaint alleges the girl’s resistance was overcome by force, violence or intoxication.
The alleged victim awoke in another room with no recollection how she got there, court records indicate. The allegations didn’t surface until mid-February, when the teen disclosed the alleged abuse to her parents.
