Legal troubles mount for manslaughter suspect

SANDPOINT — A Bonner County man awaiting trial in a vehicular manslaughter case was arrested Sunday for allegedly forcing his way in to a Sagle home and attacking a man with a baseball bat.

Peter Franklin Goullette is charged with aggravated battery with a deadly weapon and burglary for entering the Sagle Road home with the intent to commit battery. He faces three additional witness intimidation charges for threatening the alleged victim and witnesses to the crimes if they notified authorities, a criminal complaint alleges. Bonner County Chief Deputy Prosecutor Shane Greenbank is seeking sentencing enhancement because Goullette already has two prior felony convictions in Bonner County.

Goullette, 24, made an initial appearance in magistrate court on Monday via videoconferencing with the county jail. Deputy Prosecutor Roger Hanlon recommended bail be set at $250,000.

“Mister Goullette represents a menace to the public of this county,” Hanlon said.

Judge Tera Harden set Goullette’s bail at $200,000 and entered orders prohibiting him from having any contact with the alleged victims in the case.

Goullette, who advised the court he would use private counsel to represent him, doubted he could be released if he posted the sum because he was also being held on probation violations.

All three witnesses told sheriff’s deputies that Goullette burst into the home, pulled the hood over the head of the 21-year-old victim and leveled blows about the man’s head and body, according to a probable cause affidavit. They said Goullette departed, but returned and threatened to kill them if they implicated him in attack, the affidavit said.

Goullette later became the subject of a traffic stop in which he admitted confronting the alleged victim verbally, but denied committing a battery.

Goullette’s arrest comes as he awaits to stand trial for accidentally killing one pedestrian and seriously wounding another with his pickup truck on McGhee Road on June 30, 2016.

Katherine K. Stelzer was killed and Zualita L. Updike was injured in the daytime collision. Stelzer, a 61-year-old from Mead, Wash., and Updike, a 50-year-old from Clark Fork at the time of the crash, were on a break from their jobs at Litehouse Foods at the time of the collision.

Goullette has an extensive criminal history in Bonner County, according to the Idaho Supreme Court Data Repository. He has been a defendant in 45 criminal cases, 29 of which were infraction-level traffic offenses. He has prior felony convictions for burglary and unlawful possession of a firearm, in addition to misdemeanor convictions for battery, inattentive driving, racing on a public roadway and eluding law enforcement.

If convicted in the latest case, Goullette would be sentenced as a persistent violator because of his prior felonies. The sentencing enhancement would add five years to life to whatever sentence is imposed on the underlying charges.

A preliminary hearing in the case is set for March 28.

Goullette’s four-day jury trial on the felony manslaughter charge and a misdemeanor reckless driving charge is scheduled to start on April 10 in 1st District Court.
