Plea pact settles felony battery case

SANDPOINT — A Bonner County man implicated in a felony battery case was ordered Monday to perform 20 days of community service, in addition to serving time in the sheriff’s labor program.

Adam Oliver Finney entered Alford pleas to reduced charges of misdemeanor battery and disturbing the peace. Under the terms of the pleas, Finney admits no wrongdoing, but concedes he could be conviction if his case went before a jury.

Finney, 22, was initially charged with aggravated battery for allegedly breaking another man’s collarbone during a brawl outside a Clark Fork bar in April 2017. Finney’s father, Rex, was charged with two counts of aggravated battery for his alleged involvement in the fight outside the Cabinet Mountain Bar & Grill, but entered pleas to reduced charges of disturbing the peace.

Rex Finney, an attorney from a prominent family in Bonner County’s legal community, was given a suspended jail sentence and ordered to perform 100 hours of community service and pro bono legal aid.

The younger Finney was ordered to stand trial on the felony charge following a preliminary hearing earlier this year.

The state relied on witness accounts of the fight during the hearing, while the defense relied on surveillance camera footage in an attempt to contradict witness accounts. Judge William Hammlett, however, that the alleged victim’s testimony was credible enough to justify a trial in 1st District Court.

Special prosecutor Laura McClinton said the state would have argued at trial that the clash resulted from an exchange of words between the defendants and the alleged victims earlier in the evening and that Finney’s group returned to the bar and provoked a fight. While neither Adam Finney nor the alleged victim were the first to throw punches, McClinton said Adam Finney kicked and punched the alleged victim, who was downed by another combatant during the melee.

The elder Finney, meanwhile, egged his son on during the fracas, McClinton said.

“I am asking for the court to consider imposing some actual jail time as a form of punishment in this case. I do believe that is warranted,” McClinton told Judge Cynthia K. Meyer.

McClinton recommended a 180-day jail sentence with 125 days suspended, 30 days of unscheduled jail time and 20 days of actual jail time.

The alleged victim works out of state and did not attend the hearing. He did, however, provide a written victim impact statement in which he said he suffers from pain on a daily basis as a result of his injuries.

Adam Finney’s defense counsel, Boise attorney Scott McKay, recommended 10 days of jail converted into 80 hours of community service by chopping and delivering firewood to local military service veterans and their dependents.

“He will serve his community service in a way that’s productive,” said McKay, noting that the 36 cords of wood were culled from the woodlot, which underscores the community’s need for the program.

Adam Finney apologized for his misconduct before the sentence was imposed.

“I take complete responsibility for my actions and being involved in this situation,” he said.

Meyer ordered him to perform 160 hours of community service and serve five shifts on the sheriff’s labor program. She also advised Adam Finney, who is about to enter law school, that the incident will be subject to scrutiny when he seeks his license to practice.

“I have no doubt the (Idaho state) bar will make you answer for this,” said Meyer.
