Plea deal reached in assault case

SANDPOINT — A binding plea agreement is being proposed to resolve a Sandpoint’s man felony assault case, court records show.
Donavon Cleon “Gunner” Maupin pleaded guilty to amended felony assault charge during his arraignment in 1st District Court on Monday, court records show.
Maupin, 37, was charged with aggravated battery and misdemeanor battery after allegedly sucker punching one woman and throwing a beer in the face of another. The incident occurred outside the The Jammer Bar in Priest River on July 27.
Priest River Police officers were on foot patrol downtown shortly before 10:30 p.m. when they spotted the tail end of a commotion near the bar and a woman “covered” in blood, according to a probable cause affidavit. One of the alleged victims was sitting in the grass behind the bar when she encountered Maupin, who appeared to be spoiling for a fight, the affidavit said.
Maupin allegedly sucker punched a 44-year-old Sagle woman, prompting a 29-year-old Laclede woman to confront him, the affidavit said.
The Laclede woman told police Maupin threw the beer bottle in an overhand throw at her face. The bottle shattered above the woman’s left eye, causing an injury severe enough to elevate the battery charge to the felony level, according to court documents.
In a binding plea agreement with the state, Maupin pleaded guilty to a reduced charge of attempted aggravated assault. In exchange for the plea, the misdemeanor battery charge was dismissed, court records show.
The agreement, which the state and defense seek to make the court party to, recommends a 30-day jail sentence, although the defense remains free to argue for a lesser sentence, court documents indicate.
Maupin is scheduled to be sentenced on Dec. 4.
