Suit filed over deadly Dufort Rd. crash

PRIEST RIVER – A wrongful death lawsuit is being filed against a Bonners Ferry log truck driver who accidentally killed a jogger on Dufort Road last year.

Idaho State Police said Jesse Ray Flory was driving westbound when he negotiated a left-hand curve in the 16,000 block and overturned the fully loaded 1992 Kenworth log truck. A portion of the truck’s load struck and killed Katherine Rose Malone of Nashville. The Aug. 3, 2017, crash occurred on the south side of the Pend Oreille River, southeast of Priest River.

Counsel for Patrick Malone and the couple’s minor daughter filed suit in 1st District Court on Wednesday.

It seeks unspecified damages and a jury trial for wrongful death and negligence. Also named as defendants in the suit are Kevin Flory and Kevin Flory Trucking, which the plaintiffs argue are vicariously liable.

Malone’s Coeur d’Alene attorney, Michael T. Howard, said in the suit that Flory drove the right side of the tractor-trailer off the paved portion of the roadway and onto a gravel pullout.

“As Jesse Flory attempted to return to the roadway, he lost control of the log truck, which overturned and spilled its cargo upon the roadway, killing Katherine Malone, a pedestrian.” Howard said in the suit.

Malone, 36, was on a run near her family’s cabin on the river when she was killed, according to her obituary.

There is no record of Jesse Flory, who was 22 at the time of the crash, of being cited or charged in connection with the incident, according to Idaho’s online courts database. He was cited four times in Boundary County in 2013 for seatbelt violations. He was cited for speeding in Bonner County in 2014, according to the database.
