Festival director is arrested on DUI charge

SANDPOINT — The executive director of the Festival at Sandpoint was arrested on Sunday on suspicion of drunken driving and resisting arrest.

Sandpoint Police arrested Diana Marion Wahl shortly before 10 p.m. on the night of the annual waterfront concert series’ finale, court records show.

A Sandpoint officer observed a Subaru Legacy making slow and deliberate turns in central Sandpoint, raising suspicion that the driver was either lost or impaired, according to a probable cause affidavit. The officer followed the vehicle to a residence where Wahl is living.

Wahl exited the vehicle and the officer approached to speak with her. Wahl, the affidavit said, stumbled and nearly fell over twice. At a distance of 10 feet, the officer could detect the odor of alcohol and asked Wahl how much she had consumed. Wahl told him “none,” according to the affidavit. Wahl refused to complete standardized field sobriety tests and was advised she was under arrest, the affidavit said.

Wahl refused repeated commands to turn around and place her hands behind her back, the affidavit said. Wahl was taken into custody without further incident when a cover officer arrived at the scene, court records indicate.

Wahl, 56, refused to provide a blood sample at Bonner General Health, a refusal which officers overcame with a search warrant issued by a Bonner County Magistrate Court judge, court records show.

Wahl posted a $500 bond and is scheduled to be arraigned on a first-offense DUI charge Sept. 6.

Wahl’s defense counsel, Coeur d’Alene attorney Michael G. Palmer, filed a written not guilty plea in the case on Wednesday.

Wahl has four prior DUI convictions, although the latest alleged offense is being prosecuted at a misdemeanor level because she has not been charged with driving under the influence in the past 10 years.

Wahl was ordered to serve up to 60 days in jail after being convicted of a 2005 DUI offense.

Palmer is moving to disqualify the judge who sentenced Wahl in her 2005 case, records show.

Palmer on Wednesday said he had no comment on the matter.
