SUMMARY OF CITY OF SANDPOINT ORDINANCE NO. 1369 Airport Overlay Zone Amendments AN ORDINANCE OF THE CITY OF SANDPOINT, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO; AMENDING PORTIONS OF TITLE 9, CHAPTER 12, SANDPOINT CITY CODE, REGARDING AIRPORT OVERLAY ZONES; PROVIDING THAT THIS PROVISION SHALL BE DEEMED SEVERABLE AND THAT REMAINING SECTIONS OF SANDPOINT CITY CODE SHALL NOT BE AFFECTED BY A FINDING THAT THESE PROVISIONS ARE UNLAWFUL OR UNENFORCEABLE; AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE. A summary of the provisions of Ordinance No. 1369, amending Title 9, Chapter 12 of the Sandpoint City Code, are as follows: Section 1: Section 9-12-1 is amended to provide the purposes for the amended overlay zones. Section 2: Section 9-12-3 is amended to provide for an Inner Critical Zone (ICZ), Lateral Safety Zone (LSZ) and Runway Protection Zone (RPZ) within the Airport Overlay Zone District. Section 3: Section 9-12-5 is amended to provide for restriction on rezoning and provision of disclosure statements. Sections 4-5: Sections 4 and 5 provide for repeal and severability and an effective date. This publication is a summary of the full Ordinance, and is being published pursuant to Idaho Code Section 50-901A. This ordinance was passed and approved upon a proper roll call vote and duly enacted at a properly noticed session of the Sandpoint city Council, held December 18, 2019. SUMMARY OF CITY OF SANDPOINT ORDINANCE NO. 1370 Sidewalk Construction Code Repeal and Replace AN ORDINANCE OF THE CITY OF SANDPOINT, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO; AMENDING TITLE 7, CHAPTER 3, BY REPEALING AND REPLACING SECTION 10 PERTAINING TO SIDEWALK CONSTRUCTION AND AMENDING SECTION 1 PERTAINING TO RESPONSIBILITY OF SIDEWALK CONSTRUCTION AND REPAIR; PROVIDING THAT THIS PROVISION SHALL BE DEEMED SEVERABLE AND THAT REMAINING SECTIONS OF SANDPOINT CITY CODE SHALL NOT BE AFFECTED BY A FINDING THAT THESE PROVISIONS ARE UNLAWFUL OR UNENFORCEABLE; AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE. A summary of the provisions of Ordinance No. 1370, amending Sandpoint City Code Title 7, Chapter 3, as follows: Section 1: Title 7, Chapter 3, Section 10, pertaining to sidewalk construction, is repealed and replaced in its entirety, to address challenges relating to pedestrian connectivity and to provide a balanced and shared approach to funding of improvements in support of a multimodal transportation master plan; providing when new construction and/or replacement is required; providing for administration and permits; and providing for a sidewalk fee in lieu of construction. Section 2: Title 7, Chapter 3, Section 1, is amended to provide that the property owners of the City are responsible for the construction and repair of sidewalks and curbs abutting upon their respective properties, but only as required by this Chapter. Sections 3-4: Sections 3 and 4 provide for repeal and severability and an effective date.
