Silverwood embezzler pleads guilty

A Post Falls woman accused of stealing almost a million dollars from Silverwood Theme Park bonded out of jail this week after pleading guilty to three felonies.

Melissa K. Foeller, 44, who was charged with five felonies in December, pleaded guilty Tuesday in Coeur d’Alene’s First District Court to two counts of grand theft and one count of state tax evasion.

Prosecutors have asked that Foeller pay $997,432 in restitution, but the amount has not been stipulated by the court. According to the restitution memorandum filed by the Kootenai County prosecutor’s office, Foeller would pay $10,000 to Silverwood and $987,432 to the park’s insurance provider.

Foeller, an account manager at Silverwood until last year, and co-defendant Christopher A. Wyatt, 43, the business’ chief financial officer, were arrested Dec. 21 at their Post Falls homes after being indicted by a grand jury. Both were charged with five felonies for embezzling around $1 million. Wyatt has pleaded not guilty to five counts of grand theft. He posted bond last year and was released from jail, but Foeller remained in jail until paying her $50,000 bail this week.

District Judge Scott Wayman at an earlier hearing refused to reduce Foeller’s bond despite her minimal criminal history and her extensive educational background.

“She used her master’s degree to steal from her employer,” prosecutor Casey Simmons said. “She was put in a position of trust and she abused that.”

Grand theft calls for a maximum 14 years behind bars. The maximum penalty for tax evasion is five years.

Foeller’s jury trial, which was scheduled for May 1, was vacated after she changed her plea this week.

Wyatt’s jury trial is set in July.

Located 15 miles north of Coeur d’Alene, the theme park’s annual economic impact is around $80 million, according to the Department of Commerce. Silverwood regularly attracts more than 650,000 summer visitors.
