Man is accused of scuffling with trooper

SANDPOINT — A Bonner County man was Tased repeatedly and punched in the facing during a scuffle which injured an Idaho State Police trooper earlier this month, according to court documents.

Jeffrey Alan Schenk is facing felony battery on a law officer and driving under the influence charges, in addition to misdemeanor counts of eluding a law officer, resisting arrest, open container possession and driving without privileges.

Trooper Jonathan Cushman attempted to pull Schenk over on Oct. 18 for speed and equipment violations on Highway 200, but Schenk failed to yield to the trooper’s lights and siren, a probable cause affidavit alleges.

Schenk turned off on Trapper Creek Road and then onto a roundabout driveway. He drove off the driveway and was ordered to exit the vehicle and lie on the ground, but Schenk instead told the trooper to shot him, removed his coat and advanced on the officer, the affidavit said.

Cushman deployed his Taser, although the electroshock weapon failed to disrupt Schenk’s muscle control. He was jolted two more times with the device for disobeying commands and was subdued by Cushman, who said in the affidavit that Schenk was somewhat compliant and even conversational at one point.

Upon the arrival of a sheriff’s deputy, however, Schenk alleged ripped the Taser’s wired barbs, stood up and attempted to run. He was caught and in the ensuing struggle Schenk allegedly wrapped his right arm around the back of the trooper’s neck. Cushman, the affidavit said, threw Schenk to the ground but both men went down because Schenk still had a hold on Cushman’s neck.

Schenk was subdued again after receiving a sharp “hammer strike” blow to the face, according to the affidavit.

Schenk’s breath-alcohol concentration was measured 0.13, court documents indicate. The DUI charge is being prosecuted at the felony level because Schenk has three prior DUI convictions within the last 10 years.

Schenk made an initial appearance in Bonner County Magistrate Court via videoconferencing with the county jail. Judge Tera Harden set Schenk’s bail at $200,000 and appointed a public defender to represent him, according to court records.

If Schenk bonds out, he will be prohibited from using alcohol and will be required to wear a electronic tagging device which provides continuous monitoring of compliance with the court’s order.

A preliminary hearing is set for Wednesday.
