Police arrested a man this week who they said failed to report to jail after he pleaded guilty to a felony.

Spirit Lake resident Dylan C. Rogstad, 27, pleaded guilty in October to driving under the influence.

The charge came from January, when police responded to a report that Rogstad was driving drunk. Police found his car parked outside a Coeur d’Alene apartment complex with the engine running, according to court documents.

He allegedly told police he had been drinking, though he refused to provide a breath sample.

Idaho law prohibits anyone from driving or being in “actual physical control” of a vehicle — being in the driver’s seat with the motor running or the vehicle moving — while having a blood alcohol concentration of .08 percent or higher.

Police arrested Rogstad at the scene.

It was his third DUI violation in 10 years, according to court documents. A third DUI conviction is a felony in Idaho, punishable by a minimum of 30 days in jail and a maximum of 10 years behind bars.

Rogstad pleaded guilty as part of a plea agreement.

A judge sentenced Rogstad in October to four years suspended and two years of supervised probation. He was also sentenced to 28 days in jail.

He failed to report to jail, according to court documents, and a judge issued a $10,000 warrant for his arrest.

Rogstad was taken into custody on Wednesday.
