The Kootenai County Republican Central Committee’s pending lawsuit against the Coeur d’Alene School District likely won’t be filed until the new year.

Jeremy Ray Morris, the attorney representing the KCRCC, had originally intended to re-file the suit against the district by year’s end, but he told The Press Wednesday that a truncated holiday schedule made the logistics of properly filing unreasonable.

“Because it’s Christmas, and people’s schedules were so tight, we’re going to wait,” Morris said. “Getting affidavits during the holidays can be a challenge, and we want to make sure we do it right. So we’ll wait until 2021 before we file.”

Morris originally filed an injunction on behalf of the KCRCC in the Kootenai County Courthouse in mid-November. The suit claimed the school district committed viewpoint discrimination on Nov. 3, alleging the district directed law enforcement to remove supporters of conservative candidates beyond the 100-foot threshold from the polling place at Hayden Meadows Elementary School.

The suit was later dismissed on technicalities, after which Morris said the KCRCC would likely file a new suit by the end of December, this time in federal court.

In November, the Coeur d’Alene School District flatly denied the KCRCC’s Election Day claims. When asked to comment Wednesday on the delay, school district director of communications Scott Maben said the district would want to see any future lawsuits before commenting.

“We’re going to refrain from comment at this time,” Maben said. “We’ll wait and see what happens.”
