Rambo cases combined; attorney wants July trial

Two cases against Tyler Rambo, including a second-degree attempted murder case that was to be tried apart from an aggravated assault case, were combined Tuesday by a Coeur d’Alene judge.

First District Judge Cynthia K.C. Meyer agreed with prosecutors when she ruled that facts in both cases were part of a broader criminal act and could be tried together.

Rambo’s attorney, Rick Baughman, argued against joining the cases. Baughman accused prosecutors of attempting to smear his client to jurors because mixing and matching facts of the individual cases would likely prejudice a jury against Rambo.

Rambo, the 18-year-old who is accused of shooting at a man at the Fourth of July fireworks show in City Park last summer in what police call a gang-related incident, was shot by police shortly afterward when the defendant allegedly raised a firearm in their direction.

Rambo lost both legs as a result of being shot more than a dozen times by officers.

Rambo was charged separately for both incidents.

He faces a second-degree attempted murder charge for allegedly shooting at 23-year-old Jawaun Anderson.

Moments later, after attempting to flee and failing to stop for police, Rambo allegedly raised the .357 caliber handgun he carried and pointed at officers, who shot him. Until Tuesday, he faced separate aggravated assault charges for that incident.

Deputy prosecutor Jed Whitaker said one incident melded flawlessly into the next and therefore the charges should be joined into one case.

“There is zero break in the criminal action,” Whitaker said.

Baughman argued that once the shot was fired at Anderson, Rambo fled through the crowd before getting caught up in a separate incident.

“He gets away from everything,” Baughman said. “And then he runs into something else.”

Meyer said any prejudice toward Rambo by combining the cases would be outweighed by the probative value of the evidence.

Whitaker asked for mediation in the case, but Baughman refused.

“Not interested,” he said.

Baughman asked for a jury trial in July to allow him time to prepare after reviewing the evidence.

“There are 199 videos, 26 audios and about 1,000 pages of reports,” he said.

Meyer said the trial will likely be scheduled for June. The judge will meet with attorneys Friday to set a trial date.

Rambo is in jail on $1 million bail. He has filed a $9 million lawsuit against the city of Coeur d’Alene.
