SANDPOINT — A mediated settlement agreement is bringing resolution to a criminal case in which a Bonner County woman was accused of embezzling from her former employer.

Counsel for Samantha Sue Wasylko and Pend Oreille Midwifery Services reached the agreement on Feb. 7, 1st District Court records indicate. The agreement follows civil mediation meant to resolve the criminal case.

Wasylko, 44, was accused of embezzling funds from the Sandpoint birthing clinic from March to December in 2015, when she worked as an office manager. More than $10,000 in cash payments were received by the clinic and never deposited, according to court documents. Wasylko is accused of using her access to the clinic’s accounting software to delete notations of cash receipts.

Under the terms of the agreement, a $15,000 civil judgment is being entered in the case, but will not be recorded if Wasylko pays $3,000 up front and pays $7,500 in $200 monthly payments over the course of 36 months, according to court documents.

Under the terms of the pact, Wasylko admits no wrongdoing.

“This stipulation and agreement is not an admission of guilt by the defendant to the criminal charge,” Sandpoint attorney Jeremy Featherston said in court documents.

The allegations against Wasylko didn’t emerge until 2018. She pleaded not guilty to grand theft, a felony, and was slated to be tried in 1st District Court later this month.

Wasylko and Pend Oreille Midwifery are barred from making disparaging comments about one another, court records indicate.

Featherston is moving to seal the case under Idaho court administrative rules in order to protect his client’s reputation.

A hearing on the motion is set for Tuesday in district court.
