CITY OF PRIEST RIVER, IDAHO SEWER REVENUE BOND, 2020 (TAXABLE) Summary of Ordinance No. 611, adopted on June 15, 2020 AN ORDINANCE of the City of Priest River, Bonner County, Idaho, authorizing the issuance of a taxable sewer revenue bond of the City in the principal amount of $550,000 to redeem the City's Sewer Revenue Bond Anticipation Note, 2018, and to provide a portion of the permanent financing for the cost of acquiring, constructing and installing certain additions and betterments to the wastewater collection system of the City; fixing the date, form, terms, maturity and covenants of such bond; reserving the right to issue future revenue bonds on a parity with such bond upon compliance with certain conditions; and authorizing the sale of the bond to the United States Department of Agriculture Rural Utilities Service. Section 1. Definitions. Defines certain capitalized terms used in the Ordinance. Section 2. Authorization of the Bond. Authorizes the City's Sewer Revenue Bond, 2020, in an amount of $550,000 to provide a portion of the funds to finance costs of the Project. Section 3. Description of the Bond. Describes the Bond and its terms of repayment over a 40-year period with interest at the rate of 1.875% per annum and provides details regarding payments. Section 4. Prepayment and Defeasance. Allows the City to prepay and redeem principal installments of the Bond, under certain terms and conditions. Section 5. Revenue Fund and Priority of Payments. Confirms the creation of the Revenue Fund, and sets forth the priority of payments from the Revenue Fund. Section 6. Short-Lived Asset Reserve Fund. Confirms the creation of the Short-Lived Asset Reserve Fund for the purpose of depositing funds to be used by the City from time to time to replace equipment or apparatus of the System. Section 7. Bond Fund. Confirms the creation of the Bond Fund for the purpose of guaranteeing the payment of Parity Bonds. Section 8. Reserve Account. Confirms the creation of a Reserve Account within the Bond Fund to secure the payment of principal and interest Parity Bonds. Section 9. Sufficiency of Revenues. Confirms that the City has made sure there is sufficient revenue to pay the costs of operation and maintenance of the System. Section 10. Specific Covenants. Provides for certain financial and operating covenants of the City in the operation of the System. Section 11. Issuance of Future Parity Bonds. Provides for the terms and conditions on the issuance of Future Parity Bonds. Section 12. Transfer. Provides for limitations on and a method of transfer or exchange of the Bond. Section 13. Lost or Destroyed Bond. Makes provision in case the Bond is lost, stolen or destroyed. Section 14. Form of Bond. Describes the form of the Bond. Section 15. Execution of the Bond. Authorizes procedures for execution and authentication of the Bond by the appropriate officials of the City. Section 16. Sale of Bond; Authorization to Officials and Agents. Provides that the Bond shall be sold to the Government and authorizes and directs officials and agents of the City to take actions necessary thereto. Section 17. Application of Bond Proceeds. Provides that the Bond proceeds will be used to pay costs of the Project and pay costs of issuance of the Bond. Section 18. Severability. Provides that other covenants and agreements in the Ordinance are not affected if one is made invalid. Section 19. General Authorization; Ratification of Prior Acts. Authorizes Mayor and Clerk-Treasurer of the City to take appropriate steps to carry out the terms and provisions of, and complete the transactions contemplated by this ordinance. Provides that all acts taken pursuant to the authority of the ordinance but prior to its effective date are ratified and confirmed. Section 20. Validity of Issue. Provides that the Bond is issued and is valid pursuant to Idaho Code. Section 21. Effective Date. CITY OF PRIEST RIVER PUBLIC MEETING NOTICE The City of Priest River will hold a public meeting on July 6, 2020 at 5:30 pm. The meeting will be held at the Beardmore Building (50 Main Street, Suite 101 in Priest River, Idaho). The purpose of the public meeting is to present recommendations for improvements from the Priest River Water Facility Plan, Addendum No. 5. The meeting will present the water system deficiencies, proposed improvements, discuss the associated environmental impacts, funding options, and potential financial impact to the City's water users, as well as solicit verbal and written comments regarding the plan. Written comments will be accepted by the City from July 6, 2020 to July 31, 2020. A copy of the facility plan will be available for public review at the City Hall during normal business hours; it will also be available on the City's website. After considering and addressing comments, the Council will determine whether or not to implement improvements and document the decision at their Council meeting scheduled for August 3, 2020 at 6:00 pm. SUMMARY OF CITY OF SANDPOINT ORDINANCE NO. 1376 Sidewalk Cafés AN ORDINANCE OF THE CITY OF SANDPOINT, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO; AMENDING CHAPTER 2 OF TITLE 7, SANDPOINT CITY CODE, PERTAINING TO SIDEWALK CAFES; PROVIDING THAT THIS PROVISION SHALL BE DEEMED SEVERABLE AND THAT REMAINING SECTIONS OF SANDPOINT CITY CODE SHALL NOT BE AFFECTED BY A FINDING THAT THESE PROVISIONS ARE UNLAWFUL OR UNENFORCEABLE; AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE. A summary of the provisions of Ordinance No. 1376, amending Sandpoint City Code Title 7, Chapter 2, Section 2, is as follows: Section 1 amends Sandpoint City Code Title 7, Chapter 2, Section 2-F-1, by eliminating the requirement that all tables, chairs, and related services must be placed immediately adjacent to the building. Sections 2 and 3 provide for repeal and severability, publication, and an effective date. This publication is a summary of the full Ordinance and is being published pursuant to Idaho Code Section 50-901A. This ordinance was passed and approved upon a proper roll call vote and duly enacted at a properly-noticed session of the Sandpoint City Council, held June 17, 2020.
