Nevada judge hears GOP challenge to Vegas ballot counting

LAS VEGAS (AP) — The Trump campaign and Nevada Republicans were seeking a state court order Wednesday to stop mail-in ballot counting and the use of a computer to check voter signatures in Las Vegas, the state’s most populous and Democratic-leaning county.

Democrats and a deputy state attorney general told Judge James Wilson Jr. that the campaign and GOP are using unfounded and contradictory complaints to try to obstruct ballot counting in the presidential battleground state.

Clark County Registrar of Voters Joe Gloria said not using the signature scanner would require a massive mid-process overhaul to add staff, and could endanger his ability to count ballots in time.

Wilson, in Carson City, said the virtual hearing could take all day. He did not say if he planned to issue an immediate decision. But all sides expect his fast-track ruling will be appealed to the Nevada Supreme Court.

Court fights have also emerged in Michigan, New Mexico and Pennsylvania after President Donald Trump cast doubt on issues including mail-in ballots ahead of the Nov. 3 presidential election.

In Nevada, Republicans and Donald J. Trump for President Inc. complain that party observers aren’t allowed close enough to see whether ballots not accepted by the computer reader should be rejected during additional validation by election workers.

Gloria said privacy and coronavirus pandemic distancing requirements prevent over-the-shoulder monitoring of signature validation, but accommodations are made for observers from both parties.

Jesse Binnall, attorney for the GOP and Trump campaign, cited 14th Amendment rights to equal application of laws. He said observers in Las Vegas aren't getting what he called a “meaningful opportunity” to challenge mailed ballots.

“People who vote in person can have their ballot challenged,” Binnall said. “People who vote by mail cannot.”

Gregory Zunino, deputy state solicitor, drew an objection from Binnall when he called the court challenge “a numbers game."

“Clark County is a blue county,” Zunino said. “They quite frankly would like to exclude as many ballots or signatures in Clark County as they can. They want a high rejection rate.”

More than 1.27 million ballots went out in Clark County, where Democrats make up almost 41% of registered active voters and Republicans account for 28.3% of voters.

More than 294,000 ballots had been cast by mail as of Wednesday, according to state election data, and more than 98% of those were accepted as valid.

The state GOP and Trump campaign filed a separate a broad public records request Tuesday in Las Vegas to obtain the names of temporary paid ballot workers, election monitors and poll watchers along with details about their responsibilities and shifts.
