NOTICE OF PUBLIC HEARING COLWELL MCCARTHY ANNEXATION (File No. ANNX-0004-2020) NOTICE IS HEREBY GIVEN that the City Council of Post Falls will hold a public hearing at City Hall, 408 Spokane Street, on the 17 th of November, 2020 at 6:00 p.m., on a request to annex approximately 4.688 acres with a Residential Mixed (RM) zoning designation. Residential Mixed (RM): The Residential Mixed (RM) zone is intended to accommodate a mixed residential community with a variety of housing types at varying densities within the development area. Small scale neighborhood commercial/office uses may be suitable within the RM zone. This zone should be applied in areas designated for a residential land use pattern within the Comprehensive Plan's Future Land Use Map. Approval of the Residential Mixed (RM) zone requires a development agreement regulating the development siteas provided in section 18.20.190 of this title. The RM zone is appropriate for: a) Areas designated Low, Medium, or High Density Residential, or Transitional in the Comprehensive Plan. b) Areas readily serviced by collector and arterial streets suitable for higher levels of traffic. c) Areas where other public services are sufficiently available for the intensity of use. d) Areas where the configuration of municipal infrastructure and neighboring land uses are compatible with the uses allowed in the RM zone. Permitted Uses: Permitted and specially permitted uses in the RM zone are listed in the land use table in Section 18.20.030. Multi-family residential uses cannot exceed twenty percent (20%) of the total development site (gross).Neighborhood commercial/office uses cannot exceed 10 percent (10%) of the total development site (gross). Open Space Requirements: At least seven percent 7% of the total development site must be developed as open space that complies with the requirements of section 18.20.080(C)(2) of PFMC. The City Council will review the requested zoning designations against the following review criteria found within PFMC 18.16.010 and 18.20.100. - Consistent with Future Land Use Map. - Consistent with the Goals and Policies Found in the Comprehensive Plan. - Zoning is assigned following consideration of such items as street classification, traffic patterns, existing development, future land uses, community plans, and geographic or natural features. Encourage a balance of land uses to help Post Falls remain a desirable, stable, and sustainable community. - Commercial and high-density residential zoning is typically assigned along streets with a higher road classification. - Limited or neighborhood commercial and lower density residential zoning is typically assigned for properties as they proceed farther away from the higher intensity urban activity. Ensure that adequate land is available for future housing needs. - Industrial zoning is typically assigned for properties with sufficient access to major transportation routes and may be situated away from residential zoning. NOTICE OF PUBLIC HEARING RATHDRUM PLANNING AND ZONING COMMISSION The Rathdrum Planning and Zoning Commission will hold a Public Hearing on Tuesday, November 17, 2020 commencing at 6:00 PM at Rathdrum City Hall, 8047 W Main Street, Rathdrum, ID 83858. The purpose of this Public Hearing is to hear testimony regarding proposed amendment to a Planned Unit Development (PUD) which was previously approved by the Rathdrum City Council. The Thayer Farms Subdivision / Planned Unit Development is located at the northwestern corner of W. Lancaster Road and Highway 41 in the City of Rathdrum. The previous PUD approval allowed for deviation from City Code zone district regulations to allow for reduced lots sizes and reduced building setbacks among a variety of other provisions related to specific lot layouts and rights of ways. The applicant now seeks deviation from Code to allow for increased lot coverage (that portion of the lot that is occupied by the principal building and its accessory buildings) from 35% to 45%, and reduced setbacks for accessory buildings to allow any accessory building to be located within 5-feet of a rear or side property line, regardless of building size or direction of roof slope. A copy of the proposal is available for inspection by the public at the Public Works office at Rathdrum City Hall or electronically upon request. Written comments may be submitted at any time prior to the Public Hearing. In order to be included in the record to the Planning and Zoning Commission, written comments must be received at the Rathdrum Public Works office no later than 5:00 PM on November 10, 2020.
