No bail for man charged with 6th DUI

POST FALLS — A man who was arrested for allegedly driving under the influence while involved in two pending DUI cases is being held without bond.

Nicholas I. Fuson, 42, is charged with driving under the influence, a felony. He is also charged with driving without privileges and possessing an open container, both misdemeanors.

Fuson has five prior DUI convictions, prosecutors said, including two in Kootenai County. One conviction occurred in July 2013. The other occurred in January 2021.

Prosecutors said Fuson also has repeatedly failed to appear in court in the past, resulting in 18 bench warrants for his arrest.

Idaho State Police pulled Fuson over early Friday morning for an alleged traffic violation.

Fuson was wanted on a misdemeanor warrant for a parole violation stemming from a 2019 DUI charge.

Fuson also had a pending felony DUI charge, stemming from October 2020, according to court documents.

In February, Judge Ross Pittman ordered that Fuson be released on his own recognizance for the felony DUI charge.

On Friday, police said Fuson provided breath samples of 0.14 and 0.13. In Idaho, a blood alcohol level of 0.08 or more is considered impaired.

A search of Fuson’s vehicle allegedly yielded an open, partially full beer can that was cold to the touch.

Police arrested Fuson at the scene.

Judge Clark Peterson revoked Fuson’s own-recognizance release on Friday and ordered that he be held without bail.

He also ordered that Fuson be held on $250,000 bail on the second felony DUI charge.

A third DUI violation within 10 years is a felony punishable by up to a decade in prison.
