ORDINANCE NO. 660____ Hammond ZONE CHANGE FILE NO. ZC0036-21 AN ORDINANCE OF BONNER COUNTY, IDAHO, CITING ITS AUTHORITY, SAND PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP OF BONNER COUNTY BY THE RECLASSIFICATION OF LANDS GENERALLY LOCATED IN SECTION 1, TOWNSHIP 55 NORTH, RANGE 4 WEST FROM RURAL DISTRICT TO RECREATION, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Bonner County Planning and Zoning Commission did hold a public hearing on January 20, 2022 on the File ZC0036-21 request for a change in zoning designation according to the requirements for such hearings set forth at Section 67-6509, Idaho Code, and at Title 12, Bonner County Revised Code; and WHEREAS, the Bonner County Planning and Zoning Commission did find that the zone change request File ZC0036-21 is in accordance with the Bonner County Comprehensive Plan and did recommend to the Board of County Commissioners that the zone change request be approved; and WHEREAS, the Board of County Commissioners did hold a public hearing on March 9, 2022 on the File ZC0036-21 request for a change in zoning designation according to requirements of such hearings set forth at Section 67-6509, Idaho Code and at Title 12 of the Bonner County Revised Code; and WHEREAS, the Board of County Commissioners did find that the zone change request File ZC0036-21 is in accordance with the Bonner County Comprehensive Plan; NOW, THEREFORE BE IT ORDAINED, by the Board of County Commissioners that the following be and is hereby adopted as an ordinance of Bonner County, Idaho: SECTION 1: AUTHORITY This ordinance is adopted pursuant to authority granted to Bonner County at Chapter 65 of Title 67, Idaho Code. SECTION 2: AMENDING THE OFFICIAL ZONING MAP The Official Zoning Map of Bonner County, Idaho is hereby amended by the reclassification of the following described lands from Rural District to Recreation: A parcel of land, being the land described in Warranty Deed, Instrument No. 990025, located in Government Lot 1, Section 1, Township 55 North, Range 4 West, Boise-Meridian, Bonner County, State of Idaho, and being more particularly described as follows: Commencing at the northwest corner of said Section 1, a 1"1/2" iron pipe, monumenting the POINT OF BEGINNING of the herein description: Thence North 88°26'37" West, 334.50 feet, to a 1/2" rebar cap by PLS 974; Thence South 00°45'45" West, 661.13 feet, to a 1/2" rebar and cap by PLS 974; Thence South 87°19'24" East, 69.29 feet, to a 5/8" rebar and cap by PLS 9367; Thence South 88°43'28" East, 264.80 feet, to a 1/2" rebar and cap by PLS 974 on the East line of said Section 1; Thence along said East line, North 00°47'58" East, 661.18 feet, to the POINT OF BEGINNING; Less and except any portion lying within the county road rights of way along the north & east boundaries resulting in a final area of 4.47 acres. & ATTACH SURVEYORS LEGAL W/PDF Said parcel # RP 55N04W010002 A containing approximately 4.47 acres SECTION 3: EFFECTIVE DATE This ordinance shall be in full force and effect upon its passage, approval and publication in one (1) issue of the Bonner County Daily Bee Newspaper, and upon the entry of the above described zoning reclassification upon the Official Zoning Map or a Supplemental Zoning Map in accordance with the provisions set forth at Chapter 4 of Title 12 of the Bonner County Revised Code.
