Libby man facing federal charges for alleged drug dealing

A Libby man is facing federal charges of dealing fentanyl and methamphetamine.

Scott Gilbert Apgar, 41, was arraigned on March 28 in federal court in Missoula before U.S. Magistrate Judge Kathleen L. DeSoto. He pleaded not guilty to possession of controlled substances with the intent to distribute.

Apgar faces a mandatory minimum of five years to 40 years in prison, a $5 million fine and at least four years of supervised release. Apgar is locked up in the Missoula County Detention Center pending further proceedings. He will have a detention hearing on April 2 to determine if he will remain in custody. A pre-trial hearing is set for April 10.

Homeland Security Investigations, Lincoln County Sheriff’s Office, Montana Highway Patrol and Drug Enforcement Administration conducted the investigation. 

According to the grand jury that determined charges should be filed, Apgar knowing and unlawfully possessed 500 grams or more of meth and fentanyl with the intent to distribute from January 2022 to March 17, 2023, at Lakeside, In Flathead County, as well as Lincoln and Mineral counties.

He also is accused of unlawfully distributing fentanyl and meth on three other occasions, between Jan. 18, 2022, and March 7, 2022, in Lakeside.

If convicted on any of the charges, Apgar must forfeit any property constituting and derived from any proceeds obtained, any property used or intended to be used to commit the offenses and any firearm used or intended to be used to facilitate the transportation, sale, possession or concealment of the offenses.
