NO. 31476 DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SERVICE COMMISSION OF THE STATE OF MONTANA In re the NorthWestern Corporation’s Wildfire Mitigation Plan Docket 2025.08.059 August 20, 2025 Notice of Public Hearing and Opportunity for Comment 1. In 2025, the Montana Legislature enacted House Bill 490 (“HB 490”), which implemented a new process for regulated electric utilities in Montana to file wildfire mitigation plans for the Montana Public Service Commission’s (“Commission”) review and approval. HB 490 shields utilities from certain types of wildfire liability if the utility substantially follows an approved wildfire mitigation plan. A utility that satisfies the requirements of HB 490 is entitled to a rebuttable presumption that it acted reasonably in operating its electric transmission and distribution facilities. HB 490 § 3(4). The rebuttable presumption may be overcome by other evidence. Id. 2. On August 11, 2025, NorthWestern Corporation d/b/a NorthWestern Energy (“NorthWestern”) filed its first wildfire mitigation plan under the process provided in HB 490. NorthWestern requests the Commission’s approval of the plan. 3. NorthWestern’s wildfire mitigation plan must include a description of: a. Areas in which NorthWestern has electric facilities or electric transmission and distribution activities that may be subject to a heightened risk of wildfire; b. The strategies and programs that NorthWestern will use to inspect, maintain, repair, and operate its electric facilities; c. The strategies and programs that NorthWestern will use to perform vegetation management; d. The strategies for modifications or upgrades to electric facilities and preventative programs that NorthWestern will employ to reduce the risk of its electric facilities igniting a wildfire; e. The strategies and methods for de-energizing power lines and modifying electric facility operations to mitigate potential wildfires taking into consideration the ability of NorthWestern to reasonably access the proposed electric facility to be de-energized, the balance of the risk of wildfire with the need for continued supply of electricity to a community, and any potential impact to public safety, first responders, and health and communications infrastructure; f. The methods NorthWestern intends to use to restore its electrical system in the event systems are de-energized for the prevention of a wildfire; g. The estimated incremental costs associated with implementing the plan, including system improvements and upgrades; h. Community outreach and public awareness efforts before and during a wildfire season; and i. Potential participation, if applicable, with state or local wildland fire protection plans or wildfire mitigation plans. See HB 490 § 2(2). 4. Under HB 490, the Commission must review and approve NorthWestern’s wildfire mitigation plan if the Commission determines the plan: (1) contains all of the required elements listed above, (2) is in the public interest, and (3) reasonably balances the incremental costs of implementing the plan with the risk of a potential wildfire. HB 490 § 2(6). The Commission must also allow public comment on NorthWestern’s plan for a period of 45 days, hold at least one public meeting, and issue its decision within 60 days of the close of public comment. HB 490 § 2(4). 5. PLEASE TAKE NOTICE that the Commission will conduct two public meetings on NorthWestern’s wildfire mitigation plan. First, the Commission will hold a public informational meeting to hear a presentation of NorthWestern’s wildfire mitigation plan. The informational meeting will commence on September 2, 2025, at 9:00 a.m., in the Bollinger Room located in the Commission’s offices at 1701 Prospect Avenue, Helena, Montana. The Commission’s website (http://psc.mt.gov) will have a live stream of the meeting. The Commission and its staff may ask questions of NorthWestern during the informational meeting. 6. The Commission will also hold a public hearing for the purpose of receiving public comment on NorthWestern’s wildfire mitigation plan.
