NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the Bonner County Commissioners will hold a public hearing at 1:30 p.m. on January 22, 2025 in the Bonner County Administration Building, 1500 Highway 2, Sandpoint, Idaho, by Zoom teleconference, and YouTube Livestream to consider the following request: VS0006-24 - Title 40 – Paul Street. The applicants are requesting a vacation of a portion of Paul Street, a public-right-of-way, through Idaho Code Title 40. The right of way proposed to be vacated is approximately 2.5-acres. The property is generally located within Section 10, Township 59 North, Range 04  West, Boise-Meridian, Idaho. ** Written statements must be submitted to the planning department record no later than seven (7) days prior to the public hearing. ORDINANCE NO. 717  ZONE CHANGE FILE NO. ZC0007-24  An ordinance of Bonner County, Idaho, citing its authority, and providing for the amendment of the official zoning map of Bonner County by the reclassification of lands generally located in Section 15, Township 59 North, Range 1 West from Rural 10 to Rural 5 and providing for an effective date.  WHEREAS, the Bonner County Zoning Commission did hold a public hearing on September 19, 2024 on the File ZC0007-24 request for a change in zoning designation according to the requirements for such hearings set forth at Section 67-6509, Idaho Code, and at Title 12, Bonner County Revised Code; and  WHEREAS, the Bonner County Zoning Commission did find that the zone change request File ZC0007-24 IS in accordance with the Bonner County Comprehensive Plan and did recommend to the Board of County Commissioners that the zone change request be APPROVED; and  WHEREAS, the Board of County Commissioners did hold a public hearing on October 23, 2024 on the File ZC0007-24 request for a change in zoning designation according to requirements of such hearings set forth at Section 67-6509, Idaho Code and at Title 12 of the Bonner County Revised Code; and  WHEREAS, the Board of County Commissioners did not find that the zone change request File ZC0007-24 is in accordance with the Bonner County Comprehensive Plan;  WHEREAS, the Board of County Commissioners did hold a public reconsideration hearing on January 8, 2025 on the File ZC0007-24 request for a change in zoning designation according to requirements of such hearings set forth at Section 67-6509, Idaho Code and at Title 12 of the Bonner County Revised Code; and  WHEREAS, the Board of County Commissioners did find that the zone change request File ZC0007-24 is in accordance with the Bonner County Comprehensive Plan;  NOW, THEREFORE BE IT ORDAINED, by the Board of County Commissioners that the following be and is hereby adopted as an ordinance of Bonner County, Idaho:  SECTION 1: AUTHORITY  This ordinance is adopted pursuant to authority granted to Bonner County at Chapter 65 of Title 67, Idaho Code.  SECTION 2: AMENDING THE OFFICIAL ZONING MAP  The Official Zoning Map of Bonner County, Idaho is hereby amended by the reclassification of the following described lands from Rural 10 to Rural 5:  PARCEL DESCRIBED IN WARRANTY DEED FILED AS INSTRUMENT # 867499, RECORDS OF BONNER COUNTY, IDAHO  The North Half of the West Half of the Southwest Quarter of Section 15, Township 59 North Range 1 West, Boise Meridian, Bonner County, Idaho.  LESS and EXCEPT strips of land 25 feet wide along the north and west sides reserved for public roadway.  Also LESS and EXCEPT a parcel of land in the Southwest Quarter of Section 15, Township 59 North, Range 1 West, Boise Meridian, Bonner County, Idaho, being more particularly described as follows:  COMMENCING at the West Quarter of said Section 15, monumented with a 4 inch diameter concrete monument and a brass cap marked “PLS 1947” as shown on the CP&F on file and on the Record of Survey Instrument No. 432560 from which the Southwest corner of said Section 15 monumented with a 4 inch diameter concrete monument and a brass cap marked “PLS 1947” as shown on CP&F Instrument No. 559469 and on said Record of Survey, bears South 00° 15’ 38” West, 2,626.81 feet;  Thence South 89° 39’ 59” East, 1,302.50 feet along the east-west center section line of said Section 15 to the POINT OF BEGINNING;  Thence continuing along said east-west line South 89° 39’ 59” East, 25.60 feet to the Center West 1/16th corner;  Thence along the easterly line of said Northwest Quarter of the Southwest Quarter, South 00° 15’ 38” West, 1,316.12 feet to the Southwest sixteenth corner monumented with a 5/8 inch diameter iron rod and a yellow plastic cap marked “PLS 5713”;  Thence West along the southerly line of said Northwest Quarter of the Southwest Quarter, North 89° 32’ 58” West, 11.13 feet;  Thence North 00° 22’ 10” West, 1,316.19 feet to the POINT OF BEGINNING.  And EXCEPT that portion conveyed for road and utility purposes in Warranty Deed recorded as Instrument No. 141433 and subsequently conveyed to Bonner County by Deed recorded as Instrument No. 148199, records of Bonner County, Idaho.  PARCEL DESCRIBED IN WARRANTY DEED FILED AS INSTRUMENT # 1021416, RECORDS OF BONNER COUNTY, IDAHO  The Northeast Quarter of the Southwest Quarter of the Southwest Quarter; and the South Half of the Southwest Quarter of the Southwest Quarter, in Section 15, Township 59 North Range 1 West, Boise Meridian, Bonner County, Idaho.  EXCEPTING therefrom any portion within the road right of way.  PARCEL DESCRIBED IN WARRANTY DEED FILED AS INSTRUMENT # 1021417, RECORDS OF BONNER COUNTY, IDAHO  The Northwest Quarter of the Southwest Quarter of the Southwest Quarter of Section 15, Township 59 North Range 1 West, Boise Meridian, Bonner County, Idaho.  EXCEPT a strip of land 25 feet along the west side reserved for the public.  Legal#6709 AD#31784 January 16, 2025 _________________________
