Smelterville man arrested after domestic dispute turns violent

WALLACE —  A Smelterville man was charged with multiple crimes following a domestic incident Tuesday.

According to court documents, Robert Funk, 36, was arrested after deputies responded to a call from a woman, who said she was attempting to leave their shared residence after an argument escalated into an altercation. 

According to the probable cause affidavit from the investigation, the incident began after an allegedly intoxicated Funk began arguing with the woman. When the woman attempted to leave the residence, she was unable to get out of the driveway due to Funk’s vehicle blocking her in, court records state.  

Court records state that Funk then came out of the house, approached the victim’s locked vehicle, and allegedly punched the passenger door mirror, breaking it off the vehicle. According to the probable cause affidavit, when the vehicle was unlocked, Funk began punching the victim.  

Shoshone County Sheriff's Office Sgt. Ben Abshire reported Funk showed signs of intoxication but he denied striking the victim or her vehicle.

The woman also reported Funk had a hunting rifle in his possession that he kept in their bedroom. 

Funk, whose criminal history includes a previous felony conviction for domestic assault out of Washington, is not allowed to have firearms in his possession.  

Abshire said he was permitted to enter the residence where he found the loaded hunting rifle before informing Funk that he was under arrest.  

During his first appearance Wednesday, Funk was charged with felony domestic battery with traumatic injury, unlawful possession of a firearm, and misdemeanor counts of malicious injury to property and assault via a threat to do violence.  

Funk was released from Shoshone County Jail but is scheduled in court Jan. 30 for a preliminary hearing.
