SUMMARY OF ORDINANCE NO. 653  FOR THE CITY OF RATHDRUM  “HAYDEN HOMES/ARESTAD REZONE”  AN ORDINANCE OF THE CITY OF RATHDRUM, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT ZONING FOR APPROXIMATELY 124.0 ACRES OF REAL PROPERTY CURRENTLY ZONED INDUSTRIAL (I) SHALL BE REZONED TO MIXED RESIDENTIAL (MR) CLASSIFICATION; PROVIDING FOR AMENDMENT TO THE OFFICIAL ZONING MAP TO REFLECT THIS CHANGE; ADOPTING FINDINGS OF FACT; PROVIDING FOR CONDITIONS OF THE REZONE; PROVIDING SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE HEREOF.  WHEREAS, Ordinance No. 653 was duly passed by Rathdrum City Council on the 25th day of June, 2025 and recorded with Kootenai County under recording number 3010353000 on the 24th day of July, 2025.  The City of Rathdrum, Idaho (“City”) adopted Ordinance No. 653 to rezone approximately 124.0 acres of real property to Mixed Residential (MR) as described below. The Ordinance includes the following: 1) rezoning approximately 124.0 acres of property currently zoned Industrial (I) in portions of Kootenai County Parcel Nos. R-000-005-3600, R-000-005-2700, and R-000-0054200 more particularly described as:  The NW1/4 of Section 5, Township 51 North, Range 4 West, B.M., City of Rathdrum, Kootenai County, Idaho, EXCEPTING THEREFROM the north 605 feet thereof    2) amending the Rathdrum official zoning map to depict the change described above; 3) adopting findings of fact; 4) providing for conditions on the zoning; 5) providing for severability; and 6) providing that the ordinance is effective upon its passage, approval, and publication.  Conditions of Rezone: The current property owner and/or any successors or heirs shall sign and record the Development Agreement provided by the applicant with the Request for Reconsideration before any further action is requested.   It is hereby determined that publication of this summary will clearly inform the public of the intent and effect of Ordinance No. 653.
