Libby man admits guilt in assault with a weapon case

A Libby man accused of two felony counts of assault with a weapon recently pleaded guilty in Lincoln County District Court.

Ronald James Toczek, 59, was first charged after allegedly pointing a pistol at the head of a woman and her eight-month-old baby at a Vicks Lane residence on Jan. 22.

Toczek was held in the Lincoln County Detention Center before posting $75,000 bail. At a March 10 court appearance, he pleaded guilty. 

District Judge Matt Cuffe scheduled his sentencing for April 28.

According to police reports, Lincoln County Sheriff's deputies responded to a call from a woman who said that Toczek pointed a gun at her following a dispute about dirty dishes. 

Three officers responded to the residence where they met with the woman, who was a roommate of Toczek outside. Toczek, according to reports, was standing on the front of the house yelling and screaming.

According to the woman, she was sitting on the couch holding her eighth-month-old baby. She noted Toczek had been frustrated since the morning because there were a lot of dishes.

The woman told police that she had been doing dishes for weeks and she also cooked. She said her kids have been there but recently left, and they were trying to catch up on the laundry and dishes. She told Toczek that she couldn’t catch up on everything because she was exhausted and couldn’t do all the dishes.

According to police reports, the woman said that she and Toczek are not in a relationship and are just roommates and had lived there for four-and-one-half months.

The woman said she couldn’t do all the dishes, adding she had a bunch of other things to do, Toczek became irate. She said he told her not to use any of the dishes if she wasn’t going to wash them. The woman said she responded that none of the dirty dishes were from her and added she is not going to continue to do all the chores.

The woman told authorities that Toczek began “wigging out” and told her to get out. She said she didn’t have anywhere to go. Toczek told her to get out two more times and the woman refused because she said she has nowhere to go.

According to police reports, Toczek went to his bedroom, grabbed his Glock 21 .45 caliber pistol, racked the slide aggressively, and pointed it at the woman’s head, who was holding her baby, telling her to get out.
